Performing Work Not Associated with Train:
This claim is used when a manager or yardmaster instructs you do perform service on a train other
than what you are called for.
I was instructed by MYO Ben Dover to perform work not associated with my train. I am
assigned to the SO387 XE20 and was called for the MPTLF-01 on 01/01/24 at 21:00 at SO351. I
arrived at my final terminal (T'P2S0) at 06:00 and yarded my train (Or there was no MPTLF 01). MYO Ben Dover then had me and my crew get on the MLFRS 01 at the West End of Trk 210 at Kinney County Rail port, drag it in to Eagle Pass, make set out into track 11 at Clark's Park and then deliver train to Mexico interchange bridge. Claiming 1 basic day. Please refer to my FRA tie-up slip for supporting documentation.
This is a violation of Art 16 and 6 of the TP Road Agreement and the 1985 National Agreement.
Extra TSE:
Claiming a basic day on account of being called for an extra TSE in violation of Board Award 554. I was called for the _______ at ______ on ______ , which is not a regular start time for this assignment. I was called with Conductor ______ and we took the train from ______ to ______.
Running thru a home terminal:
Claim 130 mile penalty day on account of being required to run thru home terminal Del Rio. Arrived Del Rio at ____, instructed by Dispatcher/Corridor ___ to then depart Del Rio south bound to Eagle Pass. The proper crew to call for the work should have been an Eagle Pass extra board crew. After putting train away at Eagle Pass I then arrived back at Del Rio my home terminal at ______.
Road Crew Switching cars or engines not belonging to them:
Claim 130-mile penalty, on account to performing work not in connection with my train. Was called on duty at H186 (Wichita, KS) on 10/26/17 at 21:45 on the SSJABW-24. Upon arrival at the intermediate terminal at HM342 (Enid, OK), I was instructed by train dispatcher MPL to tie my train down, and handle train MENWTX-26, which was tied down in the siding at Enid, and take it to HM340 (North Enid, OK), and tie it down in the siding there. Once complete, I was then transported to my original train and continued towards my final destination at HM436 (Chickasha, OK). I got off my original train (SSJABW-24) at 05:00, and arrived at train MENWTX-26 at 05:15. Completed the irregular move at 07:30 and returned back to my original train at 07:45.
Train MENWTX-26 was never part of the train or assignment I was called for. Additionally, yard job YNE55-26 was on duty as well. The irregular work I was required to perform was not contemplated or allowed as per the 1971 National Agreement, Article V and Article VIII of Board Award 458 & PEB 219.
Properly Manning Boards
Pool Turns
Claiming a 130-mile basic day on account CMS is not staffing the protecting extra board
(XXXX-XEXX) properly, forcing pool crews to be forced to step up and work assignments
other than my own. This improper manning significantly reduces my time at home and is
contrary to first in, first out for pool turns. I was forced to step up on XXXXX-01 train off of
XXXX- XXXX (Board) on Date and Time due to insufficient manpower on the extra board
XXXX-XXXX. My turn was XX times out and showed to work XX hours later, reducing my
time to take care of personal business.
Extra-Boards
I am claiming a 130-mile basic day due to CMS improperly manning the LS372 XXXX
(Adjacent XB) and requiring me to work the XXXXX-01 (Train ID). Per the XXXX Hub
Agreement extra boards have a clearly defined coverage area, and if exhausted, current vacancy
procedures should be applied by CMS. I am permanently assigned to the XXXX XXXX and
was required to work on an assignment typically covered by extra board XXXX_XXXX.
